Kurt Benshoof is a father, a builder, and a man of quiet faith. A hardworking general contractor and skilled carpenter, he built his life with his hands. Now he is fighting to reclaim it.
He raised his son, worked with his hands, and lived as an ordinary working man in the Seattle area. Then that life was torn apart.
Kurt became known locally for opposing COVID mandates and for asserting what he believed were his medical, religious, and parental rights during the pandemic. His legal team contends that this set off a chain of events that ultimately brought the full weight of the legal system down on him.
Years of escalating legal conflict cost Kurt his freedom, his home, and precious years with his son during the years that matter most.
His attorney, Robert Barnes, has described the case as one of the most extraordinary and consequential cases he has encountered, with profound implications for parental rights, medical freedom, and constitutional safeguards.
Kurt’s legal team maintains that he is innocent, and that the record shows it. After disputes over COVID policies and an ensuing bitter custody fight, the same underlying acts were split into separate prosecutions and used to convict him in two different courts under different charges, dramatically increasing the punishment against him. He is now serving an extraordinary 11-year sentence. His counsel believes that sentence was meant to send a warning to those who challenge the system.
His legal team contends that after his son REPEATEDLY ran away from his mother’s home TO RETURN HOME TO KURT, expressed suicidal distress, and needed contact with his father, Kurt’s text messages with his son were criminalized, resulting in roughly 81 convictions tied to those communications alone. The legal team further contends that, arising from that same broader course of events, even service of legal process through third parties was treated as criminal conduct. In the defense view, all of this took place through proceedings marked by profound due process violations, including the enforcement of orders that were never legally served in the first place.
That is why this fight matters.
